ASSIGNMENT INSTRUCTIONS

Part 1: Identification of Issues Presented in Case Study Based on the selected case, write a summary report that addresses the factors/issues/concerns listed below:

1. Extract the legal principles from the fact pattern by explaining the following elements, including:

a. Legal principles discovered by considering the following list:

i. Type and nature of the criminal act

ii. Corporate culture and corporate responsibility

iii. Whistleblower law provisions (formalized policy provisions)***

b. Complaint(s) against the party submitted to an external agency

c. Critique the actions or inactions by the company that are pertinent to the decision to seek protection under the Whistleblower law

i. How did the company process the offending information internally?

ii. Did the employee go through the suggested process of reporting the offending information?

iii. How did the company initially address the problematic situation? iv. Did the employee suffer any retaliation for actions taken to publish the information?

Part 2: Analysis of the Law Based on the legal issues identified in Part 1 – Identification of Issues Presented in the Case Study, apply business law concepts, analyze ethical standards, and write a report that summarizes your analysis, and presents a draft of a whistleblower policy provision.

1. Write a report that addresses the following factors/issues/concerns:

• Based on the case, what is the issue that led to the whistleblower’s decision to report? Provide specific facts.

• What ethical standards and principles are applicable to the case? Explain.

• Based on the case facts, analyze the breadth of the company’s whistleblower policy.

 Was there a company policy that considers or addresses illegal or dishonest behavior?

Part 3: Business Strategy Proposal Based on the legal issues identified in Part 2 Analysis of the Law, write a report that examines the business and ethical principles that drive organizational change, present a draft of an ethics policy provision, and recommend a process to make outcome-based business decisions.

1. Write a report that addresses the following factors/issues/concerns:

a. Identify business law and ethical principles that drive the strategies for organizational cultural transformation. Justify your position by sharing a scripture or personal/professional examples.

b. Draft a company ethics policy provision that ensures future compliance in the area of fair dealing. I. Examples of a business ethics policy provision include the following:

c. Provide a recommendation to management on how to integrate intrinsic values in an outcome-based business decision-making process by considering the following:

i. How is the proposed recommendation aligned to the company’s mission and vision?

ii. What are some industry standards and legal requirements that may influence how the recommendation is adopted and implemented? Explain.

iii. What, if any, additional business policies are needed?

iv. How might the recommendation impact the company’s internal and external key stakeholders, such as investors, employees, and customers?
